Nothing in these Terms transfers any ownership of intellectual property to you.
6. Payment Terms
Fees for our services are set out in the engagement letter provided before work commences. Indicative fee ranges are published on this Website in Malaysian Ringgit (MYR) and are subject to confirmation. The specific scope and fee applicable to your matter will be agreed in writing before we begin.
Payment terms and accepted methods will be communicated in the engagement letter. Where work has commenced in reliance on your instructions, fees for work already performed may not be refundable upon withdrawal of instructions, subject to applicable professional rules.
We reserve the right to adjust our fee schedule. Any adjustment will not affect fees already agreed in a signed engagement letter.
7. Service-Specific Terms
Matters handled by Adil Pewaris are subject to the following service conditions:
- Scope: We will agree the scope of each matter in writing. Changes to scope should be raised promptly so that revised fee estimates can be provided.
- Client cooperation: You agree to provide documents and information reasonably requested by us and to notify us promptly of developments that may affect the matter.
- Timelines: Where timelines are discussed, these are estimates only. Court procedures, third-party responses, and other factors outside our control may affect the duration of a matter.
- Confidentiality: We maintain strict client confidentiality in accordance with our professional obligations under the Legal Profession Act 1976 (Sabah and Sarawak).
8. Disclaimers
Website content is provided for general information purposes only. While we take care to keep it current, we do not represent that it is complete or up to date and it should not be relied upon as legal advice for a specific situation.
The outcome of any legal matter depends on its individual facts and the applicable law at the relevant time. We make no representation as to the outcome of any matter we are retained to handle. Past outcomes in other matters are illustrative only and do not indicate what can be expected in your matter.
9. Limitation of Liability
To the maximum extent permitted by Malaysian law, our total liability to you in connection with the Website or services provided shall not exceed the fees paid by you for the specific matter to which the claim relates.
We are not liable for any indirect, consequential, or incidental loss arising from your use of the Website or from reliance on information published on it. This limitation does not apply where liability cannot be excluded by law, including in respect of fraud or personal injury.
10. Indemnification
You agree to indemnify us against any claims, losses, or costs (including reasonable legal fees) arising from your breach of these Terms, misuse of the Website, or provision of false or misleading information in connection with your matter.
11. Termination
Either party may end an engagement by giving written notice. We may cease acting if you fail to provide instructions, do not pay fees when due, or if continuing would place us in conflict with our professional obligations.
On termination, we will return documents belonging to you and provide a brief summary of the matter's status. Our right to be paid for work properly performed prior to termination survives the end of the engagement.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising in connection with them shall first be referred to direct discussion between the parties in good faith. If unresolved within 30 days, the dispute shall be referred to the Courts of Malaysia, and you submit to the non-exclusive jurisdiction of those courts.
Complaints about our services may also be referred to the Advocates Association of Sarawak in accordance with applicable professional regulations.
13. General Provisions
- Entire Agreement: These Terms, together with any signed engagement letter, constitute the full agreement between us in relation to Website use and service delivery.
- Severability: If any provision is found unenforceable, the remainder continues in full effect.
- No Waiver: Failure to enforce any provision does not waive the right to enforce it subsequently.
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign administrative functions to affiliated personnel.
14. Changes to These Terms
We may revise these Terms from time to time. The updated version will be posted on this page with a revised date.
